Buying and reselling airsoft is illegal? That's new.

Thats not new... at least not since 1998

The purchase and sale of replica firearms by persons not licensed to do so is a criminal offense punishable upon conviction by 5 years in prison.

no one said anything about if airsoft guns are replicas or not... clearly the CBSA thinks they are... and the RCMP thinks they are....

One thing I always wondered about, why no one ever contacted say Hojo, to establish credentials, and come on to the board and actually talk to the community.

Then they could find out first hand what we do, why, and what we're trying to accomplish, and they could at the same time inform us on what rubs them the wrong way which we could avoid doing.

Cuz the cat and mouse game is getting old, and has no real reason for being.

But wouldn't that be the government doing something intelligent?

My understanding of it (note that I'm not a legal expert) is that it probably isn't legal, but in practice the "crime" being committed is relatively harmless and there are much more important things to put resources into than going after a handful of end users trading amongst themselves, for the most part,so it's overlooked. And some of the upgraded guns wouldn't qualify as replicas, based on the available definitions.

So it's pretty much "retailers" that are being gone after (as we've seen already).

If it were to come to be enforced for individuals, I think the first thing you'd see is the admins of sites like ASC being informed the transfer laws are now being enforced and that the classifieds need to be shut down.

Then anyone who'd try getting around it, by posting ads on Craigslist or something, would be asking for it.

Well, I was referring to the RCMP. They're basically the middlemen, that have to deal with enforcing poorly worded laws. Their jobs would probably a lot easier if they had clear definitions to act on instead of having to try and perform a balancing act. So in a way they're stuck in the same boat we are (it's not like we're actively out to break the law; I think most airsofters would prefer abiding by clearly defined laws instead of being in this state of limbo)... which is part of why I wonder why they don't just talk to us. We could each make our lives a tad bit easier.

Maybe from someone that import the airsoft and resell it to us... yeah maybe. But for me to buy or sell my shit... it's kinda new. When it's in canada, it become more legal.

At least, they have a big tolerance for it.

I maybe wrong but from what I have read on here, on Brians site and else even private sales are considered a NO NO. Sales by those who have proper licenses etc can only be to person/persons within the movie industry. This is how I understand everything I have read, and if I am wrong sorry.

My response would have been:

"Am I under arrest?"

"Have a nice day".

These guys are on a fishing expedition. Do you really think they were trying to be nice? Police only ask questions in hopes in charging. Don't fool yourself.

Know your rights, and exercise them.

absolutely.
And they won't ever adress the community: in those situation they only want to talk to one person at a time.
Adressing a group is a very bad idea when you're in a position of authority and want to maintain it.

The law exists specifically to prohibit private sales of replicas.

only Licensed businesses can trade in replicas.

Sales to indivduals and sales between individuals are "illegal transfer of a prohibited device" and upon conviction subject to a penalty of 5 years in prison.

Again... the question is "are airsoft guns replicas" the answer depends on what you are doing with them.. and who's asking.
